Terms & Conditions

This agreement is entered into between Camera Master Photo and Video "Connor McNeil" and agreeing client for photography services rendered.

1. Scope of work

The Photographer agrees to provide photography services for the Client as described in the attached booking confirmation/invoice, including date, time, duration, number of images, and location preference.

Location may change due to availability. Location will be selected on a first-come basis. If you’re unavailable or do not like the other location, a time change or reschedule may be arranged.

2. Booking and Payment

Deposit: The Deposit of $20 is nonrefundable but can be transferred if your session needs to be rescheduled. Maximum of 2 reschedules before forfeiting your deposit.

Full Payment: The remaining balance of the session fee is due and payable the day before the scheduled photography session. Failure to make timely payment, or make clear communication with Camera Master, may result in the cancellation of the session.

Payment Methods: Acceptable payment methods include payment services through the Camera Master website, Cash, Cash App, or Venmo.

Additional Costs: Any additional expenses mutually agreed upon, such as travel fees, permits, or specific props, will be added to the final invoice and are due with the final payment.

Late / Incomplete Payment: A late / incomplete payment may impact the delivery time of photos and arrival time of the photographer.

3. Cancellation and Rescheduling

Client Cancellation: The Client may cancel a scheduled photography session upon giving 1 day prior notice. All deposits are non-refundable once an appointment is scheduled.

Rescheduling: After cancellation, client may request to reschedule a session no later than 1 month after the originally scheduled session without losing the deposit. The rescheduled date can not exceed more than 3 months past the originally scheduled session date. Rescheduling is subject to the Photographer's availability and may be limited.

Photographer Cancellation: In the unlikely event that the Photographer must cancel due to illness, emergency, weather or unforeseen circumstances, the Photographer will notify the Client as soon as possible and make reasonable efforts to reschedule the session.

4. Copyright and Usage Rights

Copyright Ownership: All photographs created by the Photographer remain the exclusive property of the Photographer, protected under U.S. copyright law.

Client Usage Rights: The Client is granted a personal license to use the final edited photographs for personal, non-commercial, and commercial (if agreed upon) purposes, including printing, sharing with friends and family, and posting on social media.

Photographer Usage: The Photographer may use the photographs for marketing, advertisments, portfolio, website, and social media purposes.

5. Limitation of Liability and Emergency Clause

Photographer's Liability: In the unlikely event of equipment failure, loss or damage to photographs, or the Photographer's inability to perform due to unforeseen circumstances (e.g., illness, accident, natural disaster), the Photographer's liability is limited to the return of 75% payment received for the session. The forfeited amount may be used towards another session if agreed upon by both parties.

Client's Responsibility for Safety: The Client is responsible for their own safety and the safety of any accompanying individuals during the photography session. The Photographer is not liable for accidents or injuries that occur due to the Client's negligence or disregard for safety instructions. This also includes the clients personal property and pets. If a family member or pet attacks the Photographer, all payments will be nonrefundable and legal actions may be persued.

Unsafe Conditions: The Photographer reserves the right to terminate a session immediately if the location or circumstances are deemed unsafe or dangerous (bad weather conditions or location preference) In such cases, the Photographer will be entitled to retain all payments, and the Client agrees to not hold the Photographer accountable for incomplete coverage. Rescheduling arangements may be made if agreed upon on the Photographer.

6. Client Obligations

Punctuality: The Client agrees to arrive on time for the scheduled session. Delays caused by the Client may result in reduced photography time.

Cooperation: The Client agrees to cooperate with the Photographer during the session to achieve the desired results.

7. Delivery of Images

Delivery Format: Final edited images will be delivered in high-resolution digital files available for download.

Delivery Timeline: The Photographer will deliver the final images within 10 days from the session date in ideal situations. Illness, equipment issues, or other unforeseen circumstances may push the delivery up to 30 days. If delivery is beyond 30 days, Client may be able to recieve up to 50% of the full payment.

Archiving: While the Photographer may archive the images, the Client is responsible for safely storing and backing up their own copies. The Photographer cannot guarantee the availability of images beyond 90 days after delivery.

8. Dispute Resolution

Any disputes arising from this agreement must first be attempted to be resolved through direct communication and negotiation. If an amicable resolution is not reached, the parties may consider mediation or arbitration, if specified in the contract.

9. Governing Law

This agreement shall be governed by and construed in accordance with the laws of Colorado and/or the local laws.

10. Acceptance of terms

By booking this appointment and clicking agree in the check mark box, the Client acknowledges and agrees to all terms and conditions stated. If the booking was made directly with the Photographer through use of text, email, call, or other uses of communication, you also agree to these terms and conditions.
